1. Purpose of this policy
This policy describes the use of cookies and other trackers on the website published by Galerie JAF, a limited liability company (SARL) with a share capital of EUR 600,000, Bordeaux Trade and Companies Register (RCS Bordeaux) 818 122 921, SIRET 818 122 921 00013, VAT number FR85818122921, registered office at 78 cours Georges Clemenceau, 33000 Bordeaux.
It applies to all pages of the Site, including artwork sheets, artist biographies, contact pages and, where applicable, a price-request area. It does not govern cookies deposited independently by a third-party site that the visitor would subsequently open in a new tab.
A cookie is a small file stored on the terminal (computer, tablet, phone) when a website is consulted. Other technologies produce equivalent effects: pixels, session identifiers, local storage, mobile advertising identifiers, browser fingerprinting. Unless otherwise specified, the word “cookie” here refers to all of these trackers.
This policy provides information on the purposes, durations, publishers, legal bases and the means of objecting. It should be read together with the privacy policy, which describes what happens to any personal data that may be associated with these trackers.

2. Legal framework
The use of cookies in France is governed by the “ePrivacy” Directive as transposed into Article L. 34-5 of the French Postal and Electronic Communications Code, by the GDPR when a tracker makes it possible to identify a person, and by the recommendations of the CNIL.
The principle is as follows: cookies that are strictly necessary for the service expressly requested may be placed without consent. All others — non-exempt audience measurement, advertising, social networks, third-party video players, non-essential personalisation — require prior consent that is free, informed, specific and withdrawable.
Silence, scrolling the page or continuing to browse do not constitute consent. Galerie JAF implements a banner allowing users to accept, refuse or configure the categories, with equal ease of access between refusal and acceptance.
Consent is recorded for a maximum period of thirteen months, after which it is collected again. A refusal is also stored so as not to solicit the visitor on every page.

3. Party responsible for the use of trackers
Galerie JAF, represented by its managers Falck Antony and Falck Jeremy, decides which trackers it places itself and which third-party services it activates on the Site.
When a partner (audience tool, social network, host offering statistics) places a cookie from the Site, Galerie JAF only activates that placement after the visitor’s choice, except for an exempt cookie. The partner remains fully responsible for its own policy.
Any question relating to cookies may be sent to Galerie JAF, 78 cours Georges Clemenceau, 33000 Bordeaux, or to the Site’s contact email address, subject line “Cookies”.
The publication director ensures consistency between the banner, the tracker register and this page. In the event of a new service, the list is updated before activation on the production Site.

4. Strictly necessary cookies
These cookies allow the Site to function: maintaining a session, load balancing, remembering the choice expressed on the banner, security (anti-CSRF token), and possibly a basket or form if a multi-step request exists.
Without them, the refusal of non-essential cookies could not be recorded, or a contact form could lose data being entered. They are not used to track browsing for advertising purposes.
Their legal basis is the service expressly requested and, where personal data are involved, the technical legitimate interest or the performance of pre-contractual measures (sending a message). Consent is not required.
Their duration is short: the length of the session, or a few months solely to remember the cookie choice, never exceeding the useful period. They are placed by the Site’s domain or by the host acting on behalf of the gallery.

5. Audience measurement cookies
Galerie JAF may wish to know the number of visits, the most viewed artwork pages, the type of device or the approximate country, in order to improve the Site and understand the interest shown in an exhibition.
Two situations exist. Either the tool is configured according to the CNIL exemption criteria (purpose limited to measurement, data not cross-referenced, no cross-site tracking, short retention, possibility of objection). Or the tool, in particular a global audience solution by default, is not exempt: placement then takes place only after consent.
Where possible, Galerie JAF favours respectful audience measurement (for example a self-hosted tool or a configuration without advertising sharing). Until the banner has received acceptance for this category, no non-exempt audience script should start.
Statistics are used in aggregated form. They are not used to take an automated decision concerning a named visitor, nor to sell a profile to an advertiser.

6. Social network and sharing cookies
Share buttons or embedded feeds (Instagram, Facebook and the like) may be present to relay an exhibition or an installation view. These modules may place cookies from the network, sometimes even before any click, if they are loaded too early.
Galerie JAF only activates these modules after consent to the corresponding category, or replaces them with a simple outbound link that does not embed the tracker until the visitor has left the Site.
As soon as the visitor is on the third-party platform, that platform’s policy applies. Galerie JAF has no control over the advertisements that the network will subsequently display.
It is recommended to log out of the social network before browsing a sensitive site if one wishes to limit the matching of browsing histories. This precaution is the visitor’s responsibility.

7. Third-party content, maps and players
An artwork sheet or an “access to the gallery” page may display a map, a video or a document hosted by a third party. These iframes often place playback, language or audience cookies.
They are loaded only after acceptance of the “third-party content” category, or after a click on a substitute banner (“Display the map”, “Play the video”). Until that click has taken place, a neutral space replaces the player.
Galerie JAF chooses well-known providers and states, in the cookie table, the name of the publisher (for example a maps service or video hosting service). The visitor may refuse this category without losing access to the written notices.
Reproductions of artworks hosted directly by the gallery or its main host do not, by themselves, constitute an advertising cookie.

8. Advertising, retargeting and absence of resale
Galerie JAF does not intend to turn the Site into a mass advertising network. If, in the future, a sponsored space or a retargeting pixel were contemplated, it would fall under a separate category, never pre-ticked, and would be the subject of an update to this policy before any placement.
No cookie on the Site is used to sell to brokers the list of persons who have viewed a particular painting. Interest in an artwork may become known to the gallery only if the person writes, telephones or visits 78 cours Georges Clemenceau.
Any campaigns by the gallery on external platforms (announcement of a fair, of an opening) follow the settings of those platforms. They are distinct from the Site’s cookies, even if a link may exist when a pixel is deliberately installed — which, again, would require consent.
Refusal of advertising, if this category ever appears, will not prevent consultation of the documentary collection.

9. Retention periods for trackers
Session cookies are deleted when the browser is closed. Persistent cookies have a set duration, displayed in the manager: in practice, thirteen months at most for trackers subject to consent, in accordance with CNIL doctrine.
The token that stores the “accepted / refused / customised” choice may last up to thirteen months, so as to avoid a banner on every visit. After that period, the choice is requested again.
Any audience data are aggregated or deleted according to the provider’s periods, without exceeding what is necessary. The host’s server logs (IP address, timestamp) relate to security and are retained for a short period, distinct from marketing.
A visitor may manually delete the cookies on their terminal at any time. This deletion returns the Site to the state of a first visit.

10. Personal data linked to cookies
A technical cookie may contain only an innocuous identifier. Combined with an IP address and a time of visit, it may nevertheless become personal data. Galerie JAF then applies the GDPR: minimisation, security, rights of access and objection.
The legal bases are consent for non-necessary cookies, and legitimate interest or the requested service for essential cookies. Withdrawal of consent does not cancel the lawfulness of the prior placement, but stops future placements in the category concerned.
Galerie JAF does not systematically match a cookie identifier with the name of a collector, except where necessary (security, fraud, the person’s own request, legal obligation).
GDPR rights are exercised as indicated in the privacy policy. A request “I want my audience cookies to be forgotten” results, on the gallery’s side, in the deletion of identifiers still held and in compliance with the recorded refusal.

11. Consent management on the Site
On first arrival, a banner presents: a button to accept all optional cookies; a button to refuse all optional cookies, with the same ease of use; a link to settings by category.
No optional box is pre-ticked. The details of each category can be read before the choice. A link to this policy and to the privacy policy is visible from the banner.
The visitor may change their choice at any time via a permanent “Manage cookies” link, generally in the footer. The new choice replaces the previous one.
Galerie JAF keeps proof of consent (timestamp, policy version, accepted categories) for the period necessary to demonstrate compliance with the law, then deletes or anonymises it.

12. Browser settings and automatic signals
Independently of the banner, most browsers allow third-party cookies to be blocked, deleted on closing, or all cookies to be refused. The menus are generally found under “Privacy” or “Settings”.
A total block may prevent the choice itself from being recorded or a form from being sent correctly. In that case, it is preferable to allow at least cookies from the gallery’s domain.
Galerie JAF endeavours to respect browsing signals such as Global Privacy Control or equivalents when they are technically detectable and clearly interpreted as a refusal of non-essential trackers. The status of this support is specified in the manager when it is active.
Phone applications may also offer a resettable advertising identifier. It is disabled in the system settings, outside the Site.

13. List of categories and register
Galerie JAF keeps a register of the trackers actually used, with for each: the name, the publisher, the purpose, the duration, the type (first-party or third-party) and whether or not it is subject to consent.
The usual categories are: necessary; audience; social networks and sharing; third-party content (maps, videos); possibly advanced functional cookies (chat, online appointment booking). Any category absent from the banner is not activated.
This register is updated when a provider changes, when a temporary fair involves a module, or when an audience tool is replaced. A substantial change may justify collecting consent again.
On request, the gallery communicates the list in force on the date of the request, insofar as this does not weaken the security of the systems.

14. Minors, shared terminals and professional visitors
The Site is not designed to collect the consent of a child under fifteen independently. Use of a family terminal means that the settings reflect the choice of the person who is browsing.
On a company computer, internal policies may already block certain cookies. Galerie JAF can do nothing about this; the banner still appears if the browser allows it.
Market professionals (other galleries, experts, journalists) are treated like any visitor for cookies. Any contractual data relating to them fall under the privacy policy, not the banner.
A guidebook or tablet made available in the physical gallery, if it opens the Site, must be configured to limit non-essential trackers, so as not to capture the consent of a visitor to the premises without their knowledge.

15. Consequences of refusal and quality of browsing
Refusal of optional cookies does not prevent reading the legal notices, artwork notices, biographies or sending a contact message, provided that only necessary cookies are used for these functions.
The following may, however, be unavailable: traffic statistics for the gallery, embedded share buttons, interactive maps, embedded videos, possibly a chat. Text alternatives (address, opening hours, link to an external map) remain provided.
Galerie JAF does not penalise refusal with a paywall or an artificial degradation of editorial content. A dual offer of “accept to see the artwork / refuse and see nothing” would be contrary to free consent.
The aesthetic quality of the Site (reproductions, layout) does not depend on advertising cookies.

16. Amendments, evidence and contact
This policy may change. The date shown at the top is authoritative. In the event of a major change (new advertising partner, transfer outside the EU linked to audience measurement), the banner is displayed again.
The legal notices and the privacy policy complete this text. As regards trackers, the banner and the technical register prevail over a general wording that has become obsolete, it being the gallery’s responsibility to align the three documents.
