1. Identification of the publisher
This website (hereinafter the “Site”) is published by the company Galerie JAF, a limited liability company (SARL), with a share capital of EUR 600,000.00, registered with the Bordeaux Trade and Companies Register under number 818 122 921.
The registered office is located at 78 cours Georges Clemenceau, 33000 Bordeaux, France. The SIRET number of the head-office establishment is 818 122 921 00013. The intra-Community VAT number is FR85818122921.
The declared principal activity consists in the marketing of works of art, including in particular the purchase and resale of antiques, sculptures, paintings, jewellery and objets d’art and decoration, as well as design, development and animation services related to that activity. The NAF / APE code is 47.78C (other specialised retail sale).
The company has been registered with the Bordeaux RCS since 1 February 2016 and with the National Business Register on the same date. It is active. Any identity statement appearing on the Site must remain consistent with the current Kbis extract and Sirene situation notice.

2. Publication director and legal representatives
The publication director of the Site, within the meaning of the Act of 29 July 1881 on freedom of the press and Act No. 2004-575 of 21 June 2004 for confidence in the digital economy (LCEN), is a manager of the company Galerie JAF.
The officers identified in the open databases are Falck Antony and Falck Jeremy. In the event of a plurality of managers, the company expressly designates on the Site which of them holds the capacity of publication director. That designation may be changed by an internal decision; the Site is then updated without delay.
The publication director is responsible for editorial content: artwork notices, artist biographies, gallery presentation texts, news, visiting or online sale conditions where applicable. Contributions by providers, photographers or writers remain published under the publisher’s control.
For any question relating to a specific item of content, the visitor may write to the registered-office address or to the contact email address published in the footer. A nominative request makes it possible to identify the relevant department more quickly.

3. Hosting of the Site
Hosting of the Site is provided by the technical provider chosen by Galerie JAF, OVH cloud located at 2 Rue Kellermann, 59100 Roubaix (SIREN: 424761419).
The host ensures the material continuity of the service, the security of the infrastructure and the technical retention of files, within the limits of its contract. It is not the publisher of the content and does not exercise prior editorial control over artist notices or reproductions of works.
Galerie JAF remains solely responsible for the choice of host, the configuration of backups and the retention periods of technical logs. In the event of a change of host, this section is updated.
In accordance with the LCEN, the host may be contacted by the competent authorities. Any notice of unlawful content must first be sent to the publisher in accordance with the procedures in Article 15 hereof.

4. Purpose of the Site and nature of the information
The purpose of the Site is to present Galerie JAF, its news, all or part of its collection or exhibitions, the artists it represents or documents, and, where applicable, to enable contact, a visit request or an introduction with a view to an acquisition.
Texts, notices, dimensions, techniques, years of creation, prices and biographies are provided for information and documentary purposes. Despite the care taken in research, a sheet may contain an approximation, a date “not disclosed” or an attribution pending confirmation. These elements do not constitute an enforceable expert appraisal within the meaning of the law on the sale of works of art until a certificate, a condition report or a contract has been drawn up.
Photographs of works are reproductions. Colours, textures and scales may vary according to the screen. No online reproduction replaces examination of the work on the gallery’s premises, 78 cours Georges Clemenceau in Bordeaux, or at any other announced exhibition venue.
The Site may mention works that are not, or are no longer, available for sale. The mere online posting of an image entails neither a firm offer, nor a transfer of ownership, nor a licence of use for the benefit of the visitor.

5. Access to the Site and availability
Access to the Site is, in principle, free of charge, apart from the visitor’s connection costs. Galerie JAF may nevertheless reserve certain pages (client area, press kits, price requests) for authentication.
Galerie JAF endeavours to ensure continuous access. Interruptions may occur for maintenance, updating, network failure, force majeure or the act of a third party. They give rise to no indemnity.
The publisher reserves the right to modify the architecture of the Site, to withdraw a page, to add a booking module or to close access temporarily without this constituting a fault, provided that the essential information in the legal notices remains accessible.
The visitor undertakes not to impede the operation of the Site (overload, unauthorised mass extraction, introduction of malicious code, identity theft). Any breach may result in blocking of access and, where applicable, legal proceedings.

6. Intellectual property — texts and graphic charter
The Site as a whole — structure, graphic charter, “Galerie JAF” logo, original presentation texts, compilations of notices, any databases — is protected by the Intellectual Property Code.
Any reproduction, representation, adaptation or substantial extraction, in whole or in part, on any medium whatsoever, without prior written authorisation from Galerie JAF, is prohibited and constitutes infringement, subject to the statutory exceptions (private copy, short quotation, press review, etc.).
The name Galerie JAF, the distinctive signs and, where applicable, the associated domain names are used exclusively by the company. Their registration as a trade mark, if any, is enforceable in the corresponding classes.
Artist biographies and notices written for the Site are works of the mind. Their commercial reuse (competing catalogue, marketplace, generative artificial intelligence for product purposes) is subject to agreement.

7. Intellectual property — reproduced works of art
Works reproduced on the Site (paintings, sculptures, drawings, photographs of works) remain the intellectual property of their authors or rights holders (artists, heirs, ADAGP, other collecting societies), independently of the material ownership of the support held by the gallery or by a collector.
The online posting of a reproduction by Galerie JAF takes place in the context of its art-dealing and communication activity, and transfers to the visitor no right of reproduction, adaptation, public performance or merchandising.
Any reuse of an image of a work — including a detail, a crop or integration into a creation generated by artificial intelligence — requires, as the case may be, the authorisation of the artist or of their rights holders and, where applicable, that of Galerie JAF for the photographic file of which it would be the producer.
Living artists or their rights holders may request the removal of a reproduction. Galerie JAF examines any reasoned request within a reasonable time and proceeds with removal where the law so justifies.

8. Personal data — data controller
Galerie JAF, SARL, 78 cours Georges Clemenceau, 33000 Bordeaux, SIREN 818 122 921, is the controller of personal data collected via the Site, within the meaning of Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.
Data that may be processed include in particular: identity and contact details entered in a contact form, history of requests relating to a work, technical browsing data, and, in the event of a sale, data necessary for invoicing and for the anti-money-laundering obligations applicable to the art market.
The legal basis varies according to the purpose: performance of pre-contractual measures or of a contract (price request, reservation, sale), legal obligation (accounts, invoice retention, due diligence), legitimate interest (security of the Site, evidence of correspondence), consent (newsletters, non-essential cookies).
Galerie JAF does not sell contact files. Providers (host, email tool, accountant, bank) intervene only for the needs of their assignment and on instruction.

9. Retention periods, rights of individuals and cookies
Contact data are kept for the time needed to handle the request, then for a limited period compatible with limitation periods and accounting obligations (in practice, up to five years for ordinary commercial correspondence, ten years for accounting documents). Technical logs are kept for a short period, proportionate to security.
Any person may request access, rectification, erasure, restriction, portability where it applies, and object to processing based on legitimate interest. These rights are exercised in writing with Galerie JAF at the registered-office address or by email. Proof of identity may be required in case of doubt.
A complaint may be sent to the Commission nationale de l’informatique et des libertés (CNIL), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.
The Site may place cookies necessary for its operation and, with consent, audience-measurement or sharing cookies. The consent banner makes it possible to accept, refuse or configure non-essential trackers. Refusal does not prevent consultation of informational content.

10. Obligations specific to art dealing
Galerie JAF carries on a commercial activity of dealing in works and objets d’art. Sales, when they take place, are subject to the Commercial Code, to the Consumer Code where the buyer is a consumer, and to the specific rules of the art market (droit de suite, certificates, condition reports, export, cultural goods).
Any droit de suite payable to the author or to their rights holders upon a resale is borne by the party designated by law and by the contract of sale. It is not “included” in a mere online sheet.
For certain works, export outside French territory or the European Union may require a certificate or an authorisation. The buyer is informed of this constraint in the instrument of sale. The Site does not replace that contractual information.
Galerie JAF may be subject to due-diligence obligations in the fight against money laundering and terrorist financing. It reserves the right to request any proof of identity and of the origin of funds before concluding a transaction, and to refuse an operation in the cases provided by law.

11. Prices, offers and contractual relations
Unless otherwise clearly identified as an online offer for sale, the pages of the Site do not have the nature of a shop automatically forming a distance contract. Any prices displayed are indicative, in euros, exclusive or inclusive of tax according to the statement shown, and may be changed until an offer is accepted.
Any sale is concluded in writing (order form, accepted invoice, gallery contract) specifying the work, the price, the costs, the terms of payment, of delivery or of collection at 78 cours Georges Clemenceau, and any reservations as to authenticity or condition.
Where the client is a consumer and the sale is concluded at a distance, the provisions of the Consumer Code apply, subject to the statutory exceptions specific to original works of art and to goods made to the consumer’s specifications. The right of withdrawal, where it is excluded or adapted, is recalled in the terms of sale.
Disputes arising from a sale fall under the gallery’s general terms of sale, which are distinct from these legal notices, even if they may be accessible from the same Site.

12. Liability
Galerie JAF endeavours to ensure the accuracy of the information posted online. It cannot, however, guarantee the complete absence of error, omission or discrepancy between a notice and the actual condition of a work on the day of consultation.
The publisher’s liability cannot be engaged by reason of non-conforming use of the Site, of an interpretation of a notice as a definitive expert appraisal, of an investment decision taken solely on the faith of a web page, or of a malfunction of the user’s network.
Links to third-party sites (artists, museums, catalogue raisonné databases, social networks) are offered for the visitor’s convenience. Galerie JAF has no control over those sites and declines all liability as to their content or their privacy policy.
In the event of force majeure or acte de prince (weather preventing an exhibition, administrative decision, cyberattack despite reasonable measures), online publication obligations may be suspended without indemnity.

13. Reporting of content and governing law
Any user who considers that an item of content infringes a right (infringement, defamation, invasion of privacy, unlawful content) may send a notice to Galerie JAF specifying their contact details, a description of the disputed content, its URL, the legal grounds and a copy of any useful formal notice.
The publisher examines the notice within a reasonable time. Retention or removal of the content is carried out in accordance with the LCEN and with court decisions. An abusive notice may itself engage the liability of its author.
These legal notices are governed by French law. Failing an amicable settlement, the competent courts are those determined by the rules of civil procedure and, for disputes with a consumer, those provided by the Consumer Code.
Galerie JAF informs the consumer of the possibility of referring the matter to a consumer mediator (identity and website of the affiliated mediator to be completed, for example a commerce mediator or the FEVAD if the gallery is a member) after an attempt at direct resolution.

14. Accessibility, minors and languages
Galerie JAF endeavours to make the Site viewable on common browsers and, progressively, more accessible to persons with disabilities (contrasts, text alternatives to images of works where this is possible without distorting the reproduction). Full accessibility is not guaranteed as at the date hereof.
The Site is not intended to collect data of minors under fifteen. Any form completed by a minor presupposes the agreement of the holders of parental authority. The content reproduces works of art which may, as the case may be, depict nudes; they form part of an artistic and gallery context.
The official language of the legal notices and of relations with the publisher is French. Any foreign-language version is provided only as a courtesy; in the event of a discrepancy, the French text prevails.
The visitor is invited to consult this page regularly. The update date is authoritative. Continued use of the Site after amendment constitutes acknowledgement, without prejudice to rights that cannot be waived.

15. Contact, evidence and archives

Electronic correspondence, connection logs and sending acknowledgements may be retained as evidence, in compliance with the GDPR. Printing or saving this page by the visitor is authorised for their personal information.
Galerie JAF archives successive versions of the legal notices in order to be able to evidence the content enforceable on a given date. Upon a legitimate request, an extract of an earlier version may be communicated.
Failure by the gallery immediately to exercise a right does not constitute a waiver. The invalidity of a clause does not entail the invalidity of the document as a whole.

16. Photographic credits and partners
Photographs of works, hangings and of the gallery are credited, where a third-party photographer was involved, in the caption or on a dedicated page. Unless otherwise stated, installation views may be working documents of Galerie JAF.
Logos of partners, fairs, insurers, carriers or institutions imply no reciprocal endorsement beyond the agreements in force. Their reproduction on the Site is limited to informing the public.
Any request concerning a missing credit or the removal of a photograph of a recognisable person (opening, public) is examined in the light of image rights. Persons appearing as the main subject in an event view may request blurring or removal.
Fonts, software libraries and open-source components possibly used on the Site remain subject to their respective licences, distinct from the rights attaching to the works of art.
